Legal analysis of constitutional rights to objects of the intellectual property law has been developed with regard to the institutional reforms and improvements related to the main form of civil rights protection, namely judicial protection (based on Article 55 of Constitution of Ukraine), as a result of the establishment of the High Court on Intellectual Property Issues, as well as changes in the scope and content of powers of the new Supreme Court. As has been widely acknowledged, Ukraine pertains to the group of countries with a codified system of law; however, recently the possibility of broader functions for the new Supreme Court has appeared, i.e. its judicial opinions may acquire precedential character. Nowadays specialized courts for intellectual property exist in a number of countries, including Germany, Austria, Switzerland, and the UK. Their functioning in these countries has positively affected the quality of the cases on intellectual property and has significantly reduced the time it takes to process them. A recommendation to consider the establishment of a special chamber to review disputes arising on the Internet as a part of the jurisdiction of the High Court on Intellectual Property Issues has been developed, as a result of the constitutional reform and creation of the High Court on Intellectual Property Issues. It is highly important due to the constant increase in the number of Internet infringements. The introduction into the national legislation of a provision that allows the right holder to claim compensation instead of damages resulting from the unlawful use of a trade name or a signage that is confusingly similar to another has been justified on the grounds that it will provide an opportunity for better protection of rights to commercial signage because it is sometimes extremely difficult to prove the size of damages. Compensation, in this type of case, acts as an alternative to damages.Article received 04.02.2019 ; У статті здійснено аналіз способів захисту прав на об'єкти права інтелектуальної власності з урахуванням створення Вищого суду з питань інтелектуальної власності та переосмислення статусу (зміни обсягу й змісту повноважень) Верховного Суду. Подано концепцію, відповідно до якої застосування прецеденту в правовій діяльності є нагальною потребою, для реалізації якої сформовано правові передумови. Проаналізувавши вітчизняну судову практику, рекомендовано певні напрями вдосконалення правозастосовчих механізмів, серед яких: правовласник або його представник мають враховувати необхідність надання суду доказової бази як підтвердження своїх вимог, а також строки судового провадження та інші обставини, розуміючи, що у вітчизняному законодавстві немає чітко встановлених механізмів доказу реальної шкоди або упущеної вигоди, а також розмірів можливого відшкодування збитків та методики їх нарахування. Запропоновано створити у складі Вищого суду з питань інтелектуальної власності окрему судову палату з розгляду спорів, що виникають у мережі Інтернет, адже кількість порушень у Всесвітній мережі, як свідчить світова практика, щороку стрімко зростає.Матеріал надійшов 04.02.2019

The reform of the judiciary is a key conditionality imposed by the EU, IMF and other donors to Ukraine (UA). Significant reforms of the judicial system approved by the Parliament on 2 June 2016 should gradually take effect over the coming months and years. A new Supreme Court, a strengthened system of evaluation, monitoring and appointing judges should come into being. It is the first Supreme Court selection of such scale in history. Never before had there been any competition for the UA Supreme Court. Judges, lawyers and academics were able to compete. Video streaming has been available at all testing stages, with the exception of the psychological test. On paper the independence of the judiciary should be strengthened. How far UA authorities in fact do so will depend on further actions, including the adoption of additional legislation. While the onus is on them to make these reforms work, the EU and the rest of the international community will also need to make an input sometimes on the basis of close observation of the process by taking targeted action to ensure that the reforms move in the right direction.

As a result of a country's accession to the EU, primary and secondary EU law becomes a part of the national law, which still maintains a certain autonomy. EU authorities also promote the correctness and unambiguity of the application of EU law within national jurisdictions. This is manifested primarily in the functions of the ECJ, which can provide a detailed interpretation of appeals from national courts in cases where there are doubts about the interpretation of certain legal norms of the EU.Marleasing, a methodological principle of ECJ interpretation (a term introduced by J. Pila), has been considered and supported by the principle of proportionality and national intellectual property regimes. The central element of the principle of proportionality on the basis of methodology is the doctrine of indirect effect, i.e. the directives can be applied in private law disputes and in relations between private individuals (however, the decision in the case of Marleasing insists on using only the provisions of directives themselves for resolution in such relations). A dispute is solved by using both the Member States law and the Community law, where the norms of the EU law provide the possibility of broad interpretation, and the internal rules provide for a maximum consideration of local traditions and characteristics with respect to the dispute.Marleasing should be introduced to the civil procedure activities of the judicial bodies of Ukraine.
